Information about personal data and access thereto

Pursuant to Art. 13 of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), where personal data relating to a data subject are collected from the data subject, the controller shall, at the time when personal data are obtained, provide the data subject with the following:

3 Purpose of the processing

WEBSWING LIMITED processes the disclosed personal data for multiple purposes:

For security reasons, when you visit our web sites, our web servers always store the connection data of the computer connecting with our site, a list of websites you visit within our site, the date and duration of your visit, identification data of the browser and operating system used and of the web site through which you connect to our site. Additional personal data such as the name, address, telephone location/number or email address are not collected, unless you disclose the data voluntarily, e.g. when filling-in in the contact form as part of your registration or as part of an overview, a competition, contract performance or an information requirement.

Purchasing goods and services

We process your personal data in order to be able to duly handle your order and deliver it. In case of any problems, because of your personal data, we know whom to contact.

Customer Care

If you contact us with an inquiry / a problem, we must process your data to be able to answer / solve it. 

Email marketing

We send you email marketing notifications based on your consent. You can easily unsubscribe from the notification system in the footer of the email.

4 Legal basis

Our company adheres REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL (hereinafter referred to as the “GDPR”). 

The legal basis for the processing of personal data is:

  • the consent of the data subject with the processing of personal data
  • performance of a contract to which the data subject is a party
  • a legitimate interest of the controller

Legal regulations: Postal Service Act, Personal Data Protection Act, Social Insurance Act, Labor Code, applicable wage regulations and accounting regulations, Business Code, Civil Code, Trade Licensing Act, Labor Safety and Health Protection Act, Public Health Protection, Support and Development Act.

Consent with the processing of personal data:

The data subject shall give the consent with the processing of personal data freely, without pressure, duress or threat of refusal of the contractual relationship, refusal to provide services or refusal of obligations resulting for the controller.

The data subject may withdraw his or her consent at any time, via email to the address accounts@webswing.org or in writing by mail sent to the controller's address.

The withdrawal of the consent shall not affect the lawfulness of processing based on consent before its withdrawal. 

The company deems the disclosed personal data confidential and puts particular emphasis on respecting privacy.

Legitimate interests:

We send relevant emails to our customers that help to obtain new information related to the purchase of services you have bought from us.

5 Use of web monitoring and use of cookies

We use monitoring software to determine how many users visit our web site and how often they do it. We do not use the software to collect personal data or individual IP addresses. The data is used solely in an anonymous and summary form for statistical purposes and for the development of the web site.

Use of cookies:

Cookies are small text files that might be sent to the browser and stored on your device (computer or some other device with internet access, such as a smartphone or a tablet) when you visit web sites. Cookies are stored in a folder in your browser. Cookies usually contain the name of the web site from which they originate, their duration and value. Upon the next visit of the site, the web browser downloads the cookies again and sends the information back to the web site that created the original cookies.

6 Recipients or categories of recipients

To be able to provide some services, the company needs to know some personal data of the data subjects and it needs to disclose them to other recipients for the purpose of fulfilling legal obligations and provision of top-quality services.

In addition to its business activities, the company cooperates with several processors that assure the provision in the highest possible quality. As part of their contractual activities for the company, these entities process personal data of the data subjects:

Public authorities: 

In case of enforcement of our rights, your personal data may be disclosed to a third party (e.g. an attorney). If an obligation to disclose your personal data is imposed on us by laws of the state or by a public authority (e.g. the Police Force of the SR), we are obliged to do so.

The company affirms that when selecting individual companies, it ensured that they had the professional, technical, organizational and personal capacity and ability to ensure the safety of the processed personal data by means of adopted security measures pursuant to the Personal Data Protection Act.

When selecting suitable companies, Webswing s.r.o. acted in such a manner so as not to endanger the rights and interests of data subjects protected by law.

7 Personal data storage period

The period is determined depending on the specific purpose of processing of personal data and in accordance with the requirements of specific regulations. 

Specific storage periods are set out by an internal regulation - Company's Registry Plan prepared in accordance with the Act on Archives and Registries.

In case of processing of personal data for which consent with the processing of personal data has been granted, your data will be processed for a period of 5 years or until you withdraw your consent.

The company safely destructs all personal data whose purpose of processing has ended and storage period has expired. After the defined purpose ends, the company shall be authorized to process personal data in the anonymized form in the necessary scope, for research or statistical purposes. 

The company provides for the processing of personal data of data subjects in the form enabling the identification of individual data subjects for the period that is not longer than it is necessary to achieve the purpose of the processing.

8 Conditions and method of processing of personal data of data subjects

The company does not make the processed personal data public. An exception can only be made if it is required by a special legal regulation or a decision of a court or another public authority.

Without your consent or without another legal basis, the company will not process your personal data for another purpose than the specified purpose.

9 Transfer of personal data to third countries

We process your personal data (marketing data, communication tools) using the online application Mailchimp. Mailchimp has servers located in the USA. Based on the decision of the European Commission, servers in the USA provide for appropriate protection of personal data. Mailchimp as the controller has provided appropriate assurances regarding the safety of your data and guaranteed that the personal data are processed in compliance with the GDPR. 

10 Rights of a data subject associated with the processing of his or her personal data

Based on a written request, a data subject may, with respect to all forms of processing of personal data, enforce the following rights (legal obligation, consent of the data subject, legitimate interest, contractual relationships):

  • the right to request access from the controller to personal data concerning the data subject,
  • the right to rectification of processed personal data,
  • the right to erasure of the processing of personal data (only if we are not obliged by law to store the data, e.g. invoices, tax documents, etc.),
  • the right to object to the processing of personal data,
  • the right to lodge a complaint or a motion to commence proceedings with a supervisory authority,
  • the right to a list of his or her own personal data that are subject to the processing,
  • the right to destruction of his or her personal data that are subject to the processing in case a violation of law has occurred,
  • the right to prevent the processing of his or her personal data about which he or she assumes that they are or will be processed for marketing purposes without his or her consent,
  • the right to file a motion to commence, if the data subject suspects that his or her personal data are processed without authorization.

Based on a written request, the data subject has the right (in case of consent with the processing of personal data and contractual relationships):

  • to withdraw the consent with the processing of personal data, any time
  • the right to portability of personal data from the controller to another controller, if technically possible

Based on a written request, the data subject has the right (in case of a legitimate interest):

  • to restrict the processing of his or her personal data – if the data subject suspects that we process his or her personal data unlawfully, he or she can object. If the data subject makes an objection, he or she is entitled to have us restrict the processing of his or her personal data. 

If the data subject does not have legal capacity or has not reached the age of 16, his or rights can be represented by a legal representative. 

The company shall handle a request of a data subject in compliance with the personal data protection act, free of charge, except for the payment that cannot exceed the sum of appropriate costs associated with the creation of copies, obtaining of technical media and sending of information to the data subject, unless stipulated otherwise by a special law.

 The company shall be obliged to handle the request of the data subject no later than within 30 days after the day the request is served or to inform about the reasons why the verification has not occurred and the possibility to enforce the right of the data subject to file a motion to commence and the right to other legal protection pursuant to a special regulation.

The company shall be obliged to notify the data subject, without undue delay, of a breach of the safety of personal data, if such a breach of safety of personal data could result in a high risk to the rights of the data subject.

The company has informed you – the data subject – about the protection of your personal data. You have been instructed on your rights in relation to the protection of personal data.
